Stewardship Tracking System (STS) Community of Practice (CoP) Guidelines

Data Sharing Agreement
 
The STS CoP is built upon the principle of free data sharing. Other than detailed financial information, sensitive (e.g., species at risk) or confidential (e.g., property-related) information, most of the data contributed to the STS will be made available, free of charge to the Stewardship CoP.  In the future with the agreement from the Stewardship CoP some information may be shared with the public.  No specific site locations of stewardship projects will be revealed to the public.
 
By accepting the terms of this agreement, data contributors grant all others a non-exclusive, royalty-free right to use, reproduce, extract, further develop, and distribute summaries of the data, PROVIDED that the data use respects the intellectual property rights of the data provider, data sensitivity, landowner confidentiality AND:
  1. all reproductions of the data shall carry the notices and metadata information set out in the Data Use Agreement section.
  2. all distribution of the summary data by the data user be on the same terms and conditions as contained herein.
Data contributors should strive to ensure that the information provided is accurate and of as high a quality as possible based on their capacity.
 
Data Use Agreement
 
The data user accepts the data on an "as is" basis, without representations or warranties of any kind with respect to the accuracy, usefulness, novelty, validity, scope, completeness or currency of the data. The STS CoP does not ensure or warrant compatibility with past, current or future versions of computer software to access the data.
 
The data user shall have no recourse against the data provider, its officers, directors, employees, authorized agents and contractors, whether by way of any suit or action or other, for any loss, liability, damage or cost that the data user may suffer or incur at any time, by reason of the users possession or use of the data.
 
By accepting the terms of this agreement, data users agree to acknowledge the appropriate data contributors as the source of the information in all reproductions of the data and derived products. Data users also agree to incorporate metadata in the provision of the data.
 
The University of Waterloo Computer Systems Group and the Centre for Community Mapping make no representation or warranty with respect to the adequacy of this system for any particular purpose or with respect to its adequacy to produce a particular result. In no event shall the University of Waterloo Computer Systems Group, its employees, its contractors, the Centre for Community Mapping, its employees, its contractors or the authors of this content be liable for special, direct, indirect or consequential damages, losses, costs, charges, claims, demands, or claim for lost profits, fees or expenses of any nature or kind.
 
Ownership of data and map information
 
Data collected and maps published as part of the STS are the property of the STS CoP and may be reproduced for publication within the guidelines as set by the STS CoP. Maps and imagery provided for the purpose of collecting stewardship data may not be used for any other purposes or for gathering information on private lands. Copyright of imagery must be acknowledged as it appears in the STS.

Privacy
 
Personal information of participants (including address, email and phone number) will not be shared with third parties, and will only be available to STS CoP organizations and their staff, the STS Technical Committee members, or other people designated by the CoP and/or CoP Partners for stewardship-related communications.
 
The STS CoP respects the privacy of personal information and is committed to protecting any personal information that we handle. As a basis for our own policy, we follow Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
 
Sensitive Data
 
Any data that relates to and identifies a protected species including its whereabouts or any data that could identify a private property holding including the property’s whereabouts or any data that divulge financial details regarding a private property holding that has been made by the land-owner and/or any individual organization towards any stewardship project is considered to be sensitive and is to not be made publicly available and is to be exclusively used only by that organization and its partners who have explicitly been given consent by the contributing organization.
 
Intellectual Property Rights
 
All title and Intellectual Property Rights shall remain the property of the respective data contributors and is covered by the provisions of the Copyright Act (http://laws.justice.gc.ca/en/C-42/index.html), by Canadian laws, policies, regulations and international agreements.
